Medical device maker Masimo Corp. of Irvine, CA has settled a patent lawsuit brought by Shaklee Corp. and NIR Diagnostics Inc. for an undisclosed amount.
Masimo said Pleasanton, CA-based Shaklee filed suit in July 2007, alleging Masimo violated calibration technology used in Shaklee's pulse oximeters - sensors placed on the ear or fingertip that measure the oxygen levels in the blood of a patient. NIR Diagnostics, of Ontario, Canada, later joined that suit, and the companies sought injunctions and damages.
All claims between the companies have been dismissed without prejudice, Masimo said. The company did not immediately return calls seeking comment.
