J&J Subsidiaries Ordered to Pay $16.6 Million in Patch Case

Two subsidiaries held liable for woman's death

A Chicago, IL jury has found two Johnson & Johnson (J&J) subsidiaries liable for the death of a woman who used a pain patch and awarded her estate about $16.6 million.

John DiCosolo filed the suit against J&J, Alza, Janssen Pharmaceutica and Walgreen in May 2004 following the death of his wife that year. Janice DiCosolo had used the Duragesic (fentanyl) pain patch, which the plaintiff says in his complaint “was unreasonably dangerous in design and manufacture.”

A spokesman for Janssen and Alza said the companies are considering whether to appeal.
