Ivera Medical Corporation Sues Catheter Connections

Company accuses rival of false advertising and unfair competition.

Ivera Medical Corporation has filed suit against Catheter Connections for false advertising and unfair competition under the Federal Lanham Act. The suit was filed in the U.S. District Court for the Southern District of California, Case No. 3:13-cv-2452W RBB.

The Ivera suit claims that the packaging for Catheter Connections’ Dual Cap Solo product creates the false impression that Catheter Connections is the manufacturer of those products and makes them in Salt Lake City, Utah. The suit further states that Ivera has been damaged due to these acts of false advertising and unfair competition and will continue to suffer irreparable injury unless Catheter Connections’ activities are enjoined.

“We are proud that our Curos products are actually made in the U.S.A.,” said Bob Rogers, CEO of Ivera Medical. “Given the importance many facilities place on buying American-made products, especially in U.S. government hospitals like the VA and Department of Defense, it is just not acceptable to mislead customers about the manufacturer of a product like this.”

Catheter Connections did not comment on the lawsuit.

Based in San Diego, Calif., Invera Medical manufactures, markets and sells Curos Port Protectors. The protectors are used on swabbable luer access valves as a disinfecting cleaner prior to line access and as a physical barrier to contamination between line accesses.

Catheter Connections develops and commercializes vascular access products designed to help protect patients from acquiring infections during intravenous infusion therapy. The company is based in Salt Lake City.
