Austin, TX-based ArthroCare announced that it will pay MarcTec $2.75 million to settle a patent infringement lawsuit and also announced that fourth quarter revenues will come in at $69.7 million.
The litigation settlement will cut fourth-quarter results by about 8 cents a share, ArthroCare said in a statement. The medical device manufacturer that specializes in orthopedics said it expects fourth-quarter earnings to be about 33 cents a share.
ArthroCare reached settlement in a patent infringement lawsuit brought against the company in December 2005 by MarcTec in the United States District Court for the Southern District of Illinois. The company will also make future royalty payments related to the licensing of certain MarcTec patents.
