According to a Reuters report, Royal Philips NV has been ordered to pay $467 million in a patent lawsuit to competitor Irvine, Calif.-based Masimo Corp.
Masimo sued in 2009, saying Philips’ health care division had used Masimo-patented technology to build machines that measure the amount of oxygen in a patient’s blood without requiring a sample—oximeters.
After a two-week trial, a jury at the U.S. District Court for Delaware sided with Masimo on Oct. 1, rejecting Philips’ arguments that the patents involved were “obvious” and should never have been granted.
“The entire industry respects our patents,” lawyer Joseph Re, representing Masimo, told jurors during a the trial.
“We are very disappointed in the verdict and will appeal,” Philips spokesman Steve Klink told Reuters. “We remain convinced that Philips has not infringed any valid, enforceable patent claims of the two asserted Masimo patents.”
